Important Customer Disclosures:

Uncle Warbucks loans are designed to help you meet your short-term borrowing needs. This is an expensive form of credit and is not intended to provide a solution for longer-term credit or other financial needs.

We do not always lend in every state. Our states of operation change frequently, please check back periodically to see if we are doing business in your state.

Not all loan applications are approved and are decided based on certain credit criteria. We may run credit checks on all applicants and may review credit information from national or specialized credit bureaus. Due to credit and verification requirements, not all applicants for online loans may be eligible for an installment loan by Uncle Warbucks.

Before borrowing, please consider whether you will be able to repay the amount you borrow. Make sure that you carefully review the terms and conditions of the loan that is offered to you.

IMPORTANT INFORMATION ABOUT PROCEDURES FOR APPLYING FOR A LOAN – To help fight the funding of terrorism and money laundering activities, and to comply with applicable tribal and federal law requiring all financial institutions to obtain, verify and record information that identifies each person who applies for a loan, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask for your driver’s license number or other identifying documents. Many of our customers applying for an installment loan will be required to provide extra information due to additional qualification criteria. Uncle Warbucks is a First Nations-owned business operated by a status card-holding individual, and loans are made by that individual in their capacity as a First Nations person. Uncle Warbucks may, as applicable, be subject to oversight by The First Nations Lenders’ Authority (“FNLA”). Uncle Warbucks is not chartered, licensed, or regulated by any state, provincial, or local banking or consumer credit regulator.

Late fees and non-sufficient funds/returned item fees may apply as described in your Loan Agreement and as permitted by applicable law. If you do not make a payment on time, we will attempt to contact you via one or more authorized methods. Failure to make timely payments may result in NSF or late fees. If your account becomes severely delinquent, it may be turned over to a 3rd party collection agency.

GOVERNING LAW / JURISDICTION DISCLOSURE: You acknowledge that the Lender is a First Nations-owned business operated by a status card-holding individual, and that any loan approved by Uncle Warbucks is made by that individual in their capacity as a First Nations person. Any loan that Uncle Warbucks approves, and any non-contractual obligations arising out of or in connection with it, shall be governed exclusively by the inherent laws, customs, and internal rules of the First Nations individual, as recognized under Indigenous law, together with any applicable federal law. The laws of any province, territory, state, or foreign jurisdiction-including consumer protection or credit laws-do not apply unless federal law expressly requires them to apply. All applications, transactions, and credit decisions related to your loan with Uncle Warbucks are deemed to have occurred under the legal framework described above, regardless of where you access or view this site. The laws applicable to your Loan Agreement may differ from the laws of the province, territory, or state where you reside. If you do not wish to enter into a consumer loan under these terms, you should apply for a loan from a lender located in, and licensed under the laws of, your local jurisdiction. By accepting our loan-related services, you confirm your agreement to be bound by your Loan Agreement and the laws described in the Governing Law provision thereof. For purposes of determining the place of formation and execution of the Loan Agreement, the parties agree that it shall be deemed executed under the legal framework described above, subject to any mandatory provisions of federal law. In the event of any conflict or inconsistency between the terms of these Customer Disclosures and the terms of your Loan Agreement, the terms of the Loan Agreement shall control and prevail.
